Section 504 - Children with disabilities who are not eligible for special education may qualify for additional help and accomodations under Section 504 of the Rehabilitation Act.
SAT - Student Assistance Teams
Manisfestation Hearing - A hearing to determine if a Special Education student's behavior that can lead to suspension or expulsion was a manisfestation of their disability.
• If the Team finds that the behavior was caused by the student's disability, then the child cannot be suspended, expelled or otherwise disciplined.
• Except in cases involving drugs or weapons, the child should return to his original placement. The manisfestation review can be held at the same meeting that the BIP is developed. Parents must be notified of the right to a manisfestation determination by the date the decision to suspend is made.
• If a disabled student's suspension is related to a weapon or drugs school personnel can unilaterally place a child in an "appropriate interim alternative education setting" (home tutuoring may not be a permissible interim setting) for the same amount of time a non-disabled child would be subject to discipline, but for not more than 45 days, if the child:
º "carries" certain dangerous weapons to a school or school function.
º knowingly possesses or uses illegal drugs at school or a school function.
º sells or attempts to sell a controlled substance at school or a school function.
Expulsion Hearing - If a student engaged in a behavior which leads to being expelled, a manisfestation hearing is held before the Expulsion Hearing (Special Education students). If the behavior is deemed a manisfestation of the disability, then the student can't be expelled for more than 45 days and must be provided FAPE in an alternative setting. During the interim a FBA and BIP must be created or modified to manage the behavior. If the result of the Manisfestation Hearing is the behavior was not a manisfestation of the disibility then the student can be expelled for more than 45 days.
Response to Intervention (RTI) Framework in New Mexico
What is Response to Intervention or Rtl? It is a framework being used across the country and strongly encouraged by the federal government as school systems seek ways to ensure success for all studetns, and provide early assistance to students who are experiencing academic and/or behavioral challenges.
In New Mexico, the RtI is set forth in state rule and is known as the three-tier model of student intervention as shown below:
Tier 1 - Universal Screening, Appropriate Core Instruction with Universal Interventions (for all students.)
Tier 2 - Student Assistance Team (SAT)/ Section 504 Team Process (some students)
Tier 3 - Special Education/Gifted Education (few students)
